Karachi, January 18, 2019: Sindh High Court retained Sindh Board of Revenue from collecting Stamp Duty from Imtiaz Super Market on Unexecuted Purchase Orders.
The Division Bench of High Court of Sindh headed by Justice Aqeel Ahmed Abbasi while hearing a constitutional petition filed by Imtiaz Super Market against Board of Revenue Sindh restrained the respondents from taking any coercive action against petitioner on the basis of an order for recovery of stamp duty on Rent Agreements and Purchase Orders.
The Petitioner through Amjad Javaid Hashmi Advocate has challenged the re-characterization of their Rent Agreements as Lease Agreements and ‘Internal Inventory Documents’ as ‘Purchase Orders’ by the Chief Collector of Stamps.
The counsel for the petitioner had prayed to the court that rent agreements executed by his client with different landlords cannot be treated as lease agreements which have been separately defined in the Stamps Act 1899
